The “Watch Out Loud” Teen Video Contest is conducted by I Drive Safely, LLC (“Sponsor”).
The “Watch Out Loud” video Contest (“Contest”) is designed to give Entrants ages 15 to 19, currently enrolled at a university, college (regular, junior or community), high school, or middle school, the chance to help discourage teen drivers from driving distracted.
1. ACCEPTANCE OF TERMS:
These Official Rules are made between you and the Sponsor. YOU (the “Entrant”) SHOULD READ AND UNDERSTAND THESE OFFICIAL RULES BEFORE SUBMITTING A VIDEO (AS DEFINED BELOW) TO THE CONTEST. By participating in the Contest, Entrant fully and unconditionally agrees to and accepts these Official Rules and the decisions of the Sponsor, which are final and binding in all matters related to the Video Contest. The award of a prize is contingent upon the Entrant complying with all conditions and fulfilling all requirements set forth herein. IF YOU DO NOT AGREE WITH THE TERMS AND CONDITIONS OF THESE OFFICIAL RULES PLEASE DO NOT PROVIDE A VIDEO TO THE SPONSOR AND DO NOT PARTICIPATE IN THE CONTEST.
2. ELIGIBILITY:
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. Contest is open to entrants (“Entrants”) who are legal residents of the 50 United States and the District of Columbia. Void outside of the 50 United States, the District of Columbia., and where prohibited. Entrants must be between 15 and 19 years of age at the time of entry and must possess a valid driver’s license. All Entrants must be students currently enrolled at a university, college, high school, or middle school (“School”). If under 18, Entrant must enter Contest with the express consent of a parent or guardian. Parents must sign the registration form for a minor’s entry to be valid (Official Entry Form). NO TEAM ENTRANTS WILL BE ALLOWED. A single individual must be identified as the Entrant submitting a Video. Limit one entry per person.
3. CONTEST TIMING:
The “Watch Out Loud” Video Contest begins at 8 a.m. Pacific Standard Time on Oct. 21, 2013 and ends at 11:59:59 p.m. Pacific Standard Time on December 10, 2013. The Video Contest Period consists of three (3) phases as set forth below.
Submission-Only:Phase I:
Beginning at 8 a.m. PST Oct. 21, 2013 and ending at 11:59 p.m. PST Nov. 22,2013
Public Voting Period Only:Phase II:
Beginning at 8 a.m. PST on Nov. 23, 2013 and ending at 11:59 p.m. PST Dec. 6, 2013
Winner Announcement: 8 a.m. PST Dec. 10, 2013
4. ENTERING THE CONTEST:
Step 1: Visit the Contest website located on Facebook (the “Website”) and follow the instructions to submit your Entry. You must have a Facebook account to enter from this site. If you do not have a Facebook account, you can sign up for an account for free at www.facebook.com.
Step 2: Create an original video (“Video”) not to exceed two (2) minutes in length, discouraging teen drivers from driving distracted.
Step 3: Upload your Video during the Contest Period to the Website and ensure that the Video remains viewable on the Website during the remaining portion of the Contest Period. Videos must be uploaded to the Website and must be available for Sponsor to access freely (without a password or any other restrictions). Entrants should keep at least one copy of their Video. The Sponsor is not responsible for any Videos that are lost, damaged, or that do not upload properly.
Step 4: Complete the registration forms listed below (if applicable).
- One Official Entry Form completed by Entrant (and Parent/Guardian for Entrants under 18). You will need to review and accept the Official Rules as part of the Official Entry Form.
- One Appearance Release Form completed and signed by each individual whose image or voice is used in the video indicating permission for such has been granted to the Entrant.(and Parent/Guardian signature for individuals under 18).
- One Photo Consent/Release Form requiring a parent’s signature to grant permission for I Drive Safely to use Entrant’s (under age 18) photo in connection with their participation in the Contest.
Step 5: Please submit your forms via one of the following ways: Forms can be emailed to: contest@idrivesafely.com; faxed to: 760-692-3226 Attn: Teen Video Contest; or mailed to: I Drive Safely, LLC Attn: Teen Video Contest, 5760 Fleet Street, Ste. 210, Carlsbad, CA 92008.
5. REQUIREMENTS FOR VIDEOS: The Video must:
- Be appropriate for all ages;
- Be in English;
- NOT contain any profanity, nudity, or offensive content;
- NOT contain any content that denigrates any race, disability, ethnicity, sexual orientation, religion, national origin, or other orientation or classification, or otherwise constitutes hate speech;
- NOT contain any content that denigrates or disparages the Sponsor or any other person or entity;
- NOT Contain images/videos/sounds/music that are copyrighted or which the Entrant does not have legal rights to use for public or commercial purposes;
- NOT contain any copyrighted material (music, images, etc.) or trademarks (company names, logos, brands, etc.), or infringes the intellectual property rights of any third party, unless you own or have a license to use the material for this contest. Written permission must be obtained and provided upon request for all copyrighted or trademarked materials.
- Address the Contest theme and must not have been submitted to any other competition or contest or have received an award prior to submission as an entry in this Contest.
- NOT be filmed in an unsafe manner that jeopardizes the safety of the Entrant, other people participating in the Video, or the public.
In addition, Sponsor reserves the right to reject, approve or remove any Video for any reason, in Sponsor’s sole discretion, including but not limited to Videos that negatively affect Sponsor’s relationship with its end users or that promote content, services, or activities, contrary to our competitive position, interests, or gaming philosophy. No illegible or inaudible, incomplete, forged or altered Videos will be accepted.
The Video may include other people, but Entrants must have permission from all individuals who appear in or are mentioned in the Video to use their name, voice and/or image and they must be willing to grant the rights set forth in these Official Rules. If they are not willing, please do not use them in the Video. Entrants submitting videos without such rights being granted will be disqualified.
6. TECHNICAL REQUIREMENTS FOR VIDEOS – The uploaded Video should not exceed the maximum of 100 MB file size and should be limited to the following formats: AVI, MOV, WMV, MP4, MPEG, FLV, 3GP, 3G2.
7. JUDGING CRITERIA:
Public Voting judges will base their decision on the following three criteria:
(1)The Originality and Creativity of the Video – How creative is this video in delivering the concept/message about the dangers of distracted driving?
(2)The Concept and Information Communicated in the Video – Does the video effectively communicate the concept or message that distracted driving is dangerous?
(3)The Impact and Motivation of the Video – Does this video motivate people to be more safety conscious and discourage distracted driving?
8. CONTEST JUDGING:
PRESCREENING – All Video entries will first be screened by Sponsor for compliance with the Video submission guidelines and all criteria set forth in these Official Rules.
PUBLIC VOTING – All Video entries will be available for voting by the public. Voting will be open to the public beginning at 8:00 a.m. Pacific Standard Time on Nov. 23, 2013 and will end at 11:59 p.m. Pacific Standard Time on December 6, 2013. (However, Sponsor reserves the right to modify or delay the public voting period by posting a notice to such effect on the website.) Voting will be restricted to those individuals who are 15 years of age or older. There will be a limit of one vote per person per day during the voting period.
In the event of a tie at the end of the Public Voting Period, tied entries will be re-judged by the Sponsor’s content marketing team to determine respectively the Winner/Runner up/Honorable Mention Video(s) (as applicable) based on overall creativity (50%) and expression of the distracted driving theme in the video (50%).
9. PRIZE DETAILS:
At the conclusion of public voting, based on number of votes received from the public, qualified representatives of the Sponsor will determine the three (3) finalists and will then award first, second and third prizes. The three (3) finalists will receive the following prizes:
1st Prize Winner: GoPro Camera and accessories for the winner and Sponsor will separately award Two Thousand Five Hundred Dollars ($2,500.00) directly to the School designated by the winner on the Official Entry Form to be used in support of the school’s Audio/Visual arts program.
Runner-Up:$200 Amazon Gift Card for the winner and Sponsor will separately award One Thousand Dollars ($1,000.00) directly to the School designated by the winner on the Official Entry Form to be used in support of the school’s Audio/Visual arts program.
Honorable Mention: $100 Amazon Gift Card for the winner and Sponsor will separately award One Thousand Dollars ($1,000.00) directly to the School designated by the winner on the Official Entry Form to be used in support of the school’s Audio/Visual arts program.
The prize will be awarded in the form of a check payable to the School at which the winner is enrolled as a student. Prizes, other than gift cards, are nontransferable, nonrefundable, not redeemable for cash, and may not be sold. No cash or other substitution may be given, except Sponsor reserves right in its sole discretion to make a substitution, in whole or in part, for a prize of comparable or greater value. All prizes are awarded “AS IS” and WITHOUT WARRANTY OF ANY KIND, express or implied, (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose).
To claim prize, each winner will be required to provide within the time period specified by Sponsor: (a) Proof of age, identity and residency; (b) Photocopy of a valid driver’s license; (c) Evidence satisfactory to Sponsor of winner’s enrollment as a student in the School; (d) Affidavit of eligibility/compliance with rules, publicity/liability release and indemnification signed by an authorized administrative representative(s) from the winner’s School.
Determination as to whether a school is properly accredited and/or a winner is properly enrolled in a school shall be made by the Sponsor in its sole discretion, and winners will be responsible for promptly providing any documentation relating thereto requested by the Sponsor. Sponsor reserves the right to contact the School directly. Sponsor reserves the right to contact the school directly. Failure to return the required documents in a timely manner will cause the entry to be void and an alternate winner to be selected.
By accepting the prize, each winner grants to Sponsors the right to use the winner’s name, voice, portrait, picture (“likeness”) (including but not limited to hometown and state) for purposes of advertising, trade, promotional and publicity in any and all media now known or hereafter invented, without further permission, notification or additional compensation. If the winner is a minor, such grant of rights must include written permission from the minor’s parent or legal guardian authorizing the use of the minor’s likeness on behalf of the minor. 10. WINNER NOTIFICATION AND ANNOUNCEMENT:
The winning videos will be announced to winners by Facebook message or e-mail on December 10, 2013 at 8:00 a.m. Pacific Standard Time. The winners will have three (3) calendar days to claim their prize after notification. In the event of a failure to claim or other ineligibility, alternate winners will be selected. Each entrant selected as a potential winner must comply with all terms and conditions set forth in these Official Rules, and winning is contingent upon fulfilling all such requirements. If the winner cannot be contacted within three (3) calendar days of first notification attempt, if prize or prize notification is returned as undeliverable, if winner rejects his/her prize or in the event of noncompliance with these contest rules and requirements, the prize will be forfeited and an alternate winner will be selected based on the next highest video vote score. Upon prize forfeiture, no compensation will be given.
11. TAXES:
EACH WINNER IS SOLELY RESPONSIBLE FOR REPORTING AND PAYING ALL TAXES, IF ANY, AND ANY OTHER COSTS AND EXPENSES IN CONNECTION WITH ANY PRIZE AWARDED HEREUNDER. The value of any prize awarded to a winner may be reported for tax purposes as required by law. Sponsor will furnish an Internal Revenue Service Form 1099 to winner and or winner‘s School (unless the School is exempt from taxes under the Internal Revenue Code for tax-exempt organizations) for the tax year in which the Prize was won. In the event of a waiver of the winning prize, the Sponsor may substitute or select an alternative winner. Entrant failing to provide necessary information hereby waives and releases Sponsor and its affiliates from any claim, dispute, lawsuit or the like arising out of or in connection with this Contest.
12. REPRESENTATIONS AND WARRANTIES:
You represent and warrant that the Video does not and shall not contain any material that, in Sponsor’s sole discretion: (i) falsely states or otherwise misrepresents your affiliation with a person or entity, without such person or entity’s prior written consent; (ii) constitutes personally identifying information or other personal or identifying information about you or any individual; (iii) is false, deceptive, misleading, scandalous, indecent, obscene, pornographic, unlawful, defamatory, libelous, fraudulent, tortious, threatening, harassing, hateful, degrading, intimidating, or racially or ethnically offensive, or contains nudity, pornographic images, explicit sexual themes, or graphic violence; (iv) encourages conduct that could be considered a criminal offense, could give rise to criminal civil liability, or could violate any law, or that could otherwise be considered inappropriate; (v) constitutes a virus, worm, Trojan Horse, easter egg, time bomb, spyware, or other computer code, file, or program that is harmful or invasive or is intended to damage or hijack the operation of, or to monitor the use of, the Contest Site or any hardware, software, or equipment; (vi) constitutes any advertising, promotional material, or other form of solicitation; or (vii) constitutes any material, non-public information about a Sponsor. Any Video that would violate any law or regulation, or these Official Rules, will not be considered. Sponsor retains sole discretion as to what constitutes unsuitable content, and to disqualify the Entrant from participation in the Contest. A Video that is submitted in violation of these Official Rules; that is received in whole or in part after the end of the Contest Period; or that is incomplete, illegible, corrupted, or damaged, will be discarded and deemed to be VOID.
13. ENTRANT’S RIGHTS TO VIDEOS:
By submitting your video, you represent and warrant that (i) all information that you provide through the Contest Site in connection with the submission of a Video, including without limitation any registration information, is and will remain true, accurate, and complete; (ii) you have the legal right to enter into these Official Rules with Sponsor; (iii) the Video is your original, sole work; (iv) you solely own, or otherwise have the full right and permission to exploit, all of the rights in, to, and under the Video and to grant Sponsor the rights and licenses set forth herein, and with respect to any third party materials that appear in or are otherwise incorporated or embodied in the Video, you have obtained express, written clearances from all owners of and rights holders in such third party materials as necessary to grant Sponsor the rights and licenses set forth herein, and you will provide such clearances to Sponsor upon request; (v) you have obtained the written consent, release, and/or permission of every identifiable individual who appears in the Video, to use such individual’s name and likeness for purposes of using and otherwise exploiting the Video in the manner contemplated by these Official Rules and, or, if any such identifiable individual is under the age of eighteen (18), you have obtained such written consent, release and/or permission from such individual’s parent or guardian, and you will provide such consents, releases and/or permissions to Sponsor upon request; (vi) the Video, and the use thereof by Sponsor and Sponsor’s respective designees, do not and shall not infringe upon or violate any patent, copyright, trademark, trade secret, publicity or other intellectual property rights or other rights of any third party; (vii) the Video is not confidential and does not contain any confidential information; and (viii) in creating the Video, preparing the Video for submission, and submitting the Video, you (A) have complied and will comply in all respects with all applicable laws, rules, and regulations and (B) have not violated and will not violate any understanding by which you are explicitly or implicitly bound (including without limitation any agreement with any third party). Sponsor reserves the right at any time in its sole discretion (but has no obligation) to verify that all necessary rights, clearances, consents, releases, and/or permissions in or relating to your Video have been obtained. Sponsor reserves the right to disqualify you from the Contest, and to refuse or reject your Video, if Sponsor determines at any time, in its sole discretion, that all necessary rights, clearances, consents, releases, and/or permissions have not been obtained by you. You agree to cooperate with Sponsor in any verification or inquiries related to the foregoing. This Section shall survive any expiration or termination of these Official Rules.
14. SPONSOR’S RIGHTS TO USE SUBMITTED VIDEOS AND ENTRANT’S NAME:
All submitted Videos remain the intellectual property of the Entrant, subject to the following: By submitting a Video for consideration in the Contest, you irrevocably agree to grant, and actually grant Sponsor a perpetual, worldwide, irrevocable, unlimited, transferable, assignable, sublicensable, royalty-free right and license to reproduce, publish (on Sponsor’s website(s), on any other website(s), in print, radio, television or elsewhere), display, modify, translate, adapt, rebroadcast, and otherwise use the Video in whole or in part and as edited by Sponsor, in all media for educational, commercial and other uses (including but not limited to usage in advertising, publications or promotional materials), now known or in the future discovered, in Sponsor’s sole discretion, in any way, in any and all media, without limitation and without any compensation or prior review by Entrant or acknowledgment to you or any third party, whether or not the Video is selected as a Winning Video. As a condition of receiving a Prize, all Potential Winners agree to the license granted above. All Entrants further acknowledge that Sponsor is under no obligation to return, post, display or otherwise use your submitted Video. All Entrants hereby agree not to instigate, support, or maintain, any action, claim, or lawsuit against Sponsor. Sponsor, their partners, affiliates, agents, licensees, prize providers or any other person, on the grounds that any use of the Video, or any derivative work from such Video infringe any of your rights as creator of the Video, including, without limitation, trademark rights, copyrights, publicity rights, privacy rights, and moral rights. Nothing herein shall create or constitute an employment, joint venture, or partnership relationship between you and Sponsor. In no way are you to be construed as the agent or to be acting as the agent of Sponsor in any respect, or will you have the power to bind Sponsor in any way. Except as otherwise prohibited by law, Entrant grants permission to Sponsor to use Entrant’s name and/or city/ state of residence in connection with any use of the Video in any and all media, worldwide in perpetuity without further compensation or consent, including but not limited to possible television, radio or internet interviews. By entering, Entrants acknowledge that Videos may be available to the public and that no privacy to ideas submitted is guaranteed. This Section shall survive any expiration or termination of these Official Rules.
15. LIMITATIONS OF LIABILITY AND RELEASE:
No liability or responsibility is assumed by Sponsor resulting from Entrant’s submission in the contest in or attempt to participate in the contest or ability or inability to upload or download any information in connection with the contest. No responsibility or liability is assumed by the Sponsor for technical problems or technical malfunction arising in connection with any of the following occurrences which may affect the operation of the contest: hardware or software errors; faulty computer, cable, satellite, network, electronic, Internet connectivity or other online or network communication problems; errors or limitations of any Internet service providers, servers, hosts or other providers; garbled, jumbled or faulty data transmissions; failure of any online transmissions to be sent or received; lost, late, delayed or intercepted transmissions; inaccessibility of the website in whole or in part for any reason; traffic congestion on the Internet or the website; or non-human intervention of the operation of the contest, including without limitation, , hacking, theft, virus, bugs, or worms; or destruction of any aspect of the contest, or loss, miscount, misdirection, inaccessibility or unavailability of an email account used in connection with the contest. Sponsor is not responsible for any printing, typographical, technical, computer, network or human error which may occur in the administration of the contest, the uploading, the processing or judging of submissions or votes or the tabulating of votes, the announcement of the prizes or in any contest-related materials. Use of website is at user’s own risk. Sponsor is not responsible for any personal injury or property damage or losses of any kind which may be sustained to user’s or any other person’s computer equipment resulting from participation in the contest. Should any portion of the contest be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, human intervention, technical failures or other causes which, in the sole opinion of Sponsor, corrupt or impair the administration, security, fairness or proper play, or uploading of submissions, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the contest, and select the winners from eligible submissions received prior to action taken or as otherwise deemed fair and appropriate by Sponsor.
16. CONDITIONS OF PARTICIPATION:
By participating in the contest, Entrant (and Entrant’s parent or legal guardian if Entrant is a minor) agree (and agree to confirm in writing) (a) to release Sponsor from any and all claims, damages or liabilities arising from or relating to such Entrant’s participation in the contest; and (b) Entrants waive all rights to claim, punitive, incidental, consequential, or any other damages. If a finalist/winner is found to be ineligible or not in compliance with these Official Rules, the prize(s) may be forfeited and an alternate winner may be selected.
17. GENERAL PROVISIONS
Privacy: All entrants agree to share their first name and last initial, as well as their likeness (via a public “Profile Picture”) on their official Contest Profile page. The full names of the Entrants that are prizewinners will be made public.
Disruptions of the Contest: Sponsor may prohibit any Entrant or potential Entrant from participating in the Contest or receiving any prize if any person associated with an Entrant shows a disregard for these Official Rules; acts with an intent to annoy, abuse, threaten, or harass any other Entrant, Sponsor, or their agents or representatives; or acts in any other disruptive manner. These determinations will be made by Sponsor in its sole discretion. In addition, if any Entrant attempts deliberately to damage any website (including the Website) or undermines the legitimate operation of the Contest, Sponsor reserves the right to seek damages from that Entrant to the fullest extent permitted by law or to take any other available legal action.
Postponement or Cancellation: Sponsor reserves the right to postpone, cancel, suspend or modify the Contest in any manner and for any reason without notice, in its sole discretion. Sponsor also reserves the right in its sole discretion, to cancel, suspend or modify the Contest (and to disqualify any implicated Entrant(s) (whether eligible or not) if fraud, virus, actions by Entrants, technical or other error or problem of any kind, or any other occurrence corrupts or affects the administration, integrity, security, or proper play of the Contest, as determined by Sponsor in its sole discretion. If the Contest is cancelled, Sponsor reserves the right, at its sole discretion, to conduct judging and to award prize(s) for the applicable Contest Period from among all eligible, non-suspect entries received for that Contest Period up to the time of the event or action warranting cancellation. If the Contest is cancelled before the stated end date, a notice will be posted on the Website.
Governing Law:These Official Rules are governed by and should be construed in accordance with the laws of the State of California, applicable to contracts made and performed in that State, without giving effect to any choice or conflict of law rules or provisions which would result in the application of the laws of any other jurisdiction. If any Entrant (including an ineligible Entrant) and Sponsor are unable otherwise to resolve any claim or controversy arising out of or relating to the Contest, the Official Rules, or the Entrant’s eligibility (“Claim”), they irrevocably agree to submit the Claim to binding arbitration conducted in the County of San Diego.
